These Terms of Use ("Terms") govern your access to and use of the Fax Send: Faxing PDF Documents iOS app ("the App"). By downloading or using the App, you agree to these Terms.
1. License
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, subject to these Terms and the Apple App Store license terms.
2. Subscriptions
The App offers the following subscription plans:
- Weekly: $7.99 per week
- Monthly: $12.99 per month
- Annual: $49.99 per year
Subscriptions automatically renew at the end of each billing period at the same price, unless cancelled at least 24 hours before the period ends. Your Apple ID account will be charged for renewal within 24 hours of the end of the current period.
Managing & Cancelling
You can manage and cancel your subscription at any time via Settings → Apple ID → Subscriptions on your iPhone. Cancellation takes effect at the end of the current billing period; partial refunds are not provided for unused time.
3. Pay-Per-Fax Credits
The App also offers one-time fax credit purchases (e.g. 1 credit for $0.59, 5 credits for $2.79 and larger bundles). Credits are non-refundable and may expire according to the terms disclosed at purchase. Credits are consumable: once used to send a fax, they are spent.
4. Free Trials & Promotions
If a free trial is offered, it converts automatically into a paid subscription at the end of the trial unless cancelled beforehand. Promotional prices apply only to the initial billing period and renew at the standard price thereafter.
5. Acceptable Use
You agree not to use the App to send unsolicited faxes (spam), fraudulent communications, illegal content, content that infringes third-party rights, or content that violates applicable law. We reserve the right to suspend or terminate accounts that violate these rules.
6. Delivery Not Guaranteed
Fax delivery depends on third-party telecommunications networks, the recipient's fax machine and line quality. While we strive for reliable delivery, we do not guarantee that every fax will be delivered successfully. You are responsible for verifying important deliveries and may receive a "Failed" status if delivery cannot be completed.
7. Intellectual Property
The App and all associated content, branding, code and trademarks are owned by us or our licensors and protected by applicable intellectual property laws. You retain ownership of the documents you send through the App.
8. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, express or implied. We disclaim all implied warranties including merchantability, fitness for a particular purpose and non-infringement, to the maximum extent permitted by law.
9. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for any loss of profits or data arising from your use of the App. Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim.
10. Changes to the Terms
We may update these Terms from time to time. The updated version will be posted at this URL with a revised "Last updated" date. Continued use of the App after changes constitutes acceptance.
11. Termination
We may suspend or terminate your access to the App at any time for violation of these Terms. You may stop using the App at any time by uninstalling it and cancelling any active subscriptions.
12. Governing Law
These Terms are governed by applicable local law. Disputes that cannot be resolved informally will be handled in accordance with the jurisdiction of your residence, consistent with App Store rules.
